Terms of Service

These are the terms between Antojo.ai and the restaurants that buy our setup and monthly service. They are written in plain language on purpose.

Who we are

Antojo.ai ("Antojo.ai", "we", "us") provides online ordering software and done-for-you setup services to independent restaurants in the United States. We are based in Utah County, Utah. You can reach us at support@antojo.ai.

These terms apply to the restaurant owner or business ("you", "the restaurant") that buys our setup and service. They cover the antojo.ai website, the setup we perform, and the monthly service. They do not govern the people who order food from your restaurant; those diners are covered by the terms and privacy policy shown on your own ordering site.

What we sell

We sell one thing, in two parts.

The setup, $2,999 one time. It includes an online ordering site on your own domain; your menu built and loaded (sections, items, prices and descriptions); photos of your dishes, shot by us or edited from the ones you send; a Samsung kitchen tablet; a Star thermal printer; a pre-configured travel router; on-site installation at your restaurant; opening your Stripe account with you in person; printed materials (to-go stickers, table tents, table stickers and window graphics); and setting up your Google Business Profile and pointing its "Order Online" button at your site.

The monthly service, $99 per location per month. It includes hosting your ordering site, unlimited menu changes, and support in Spanish by text message or WhatsApp, seven days a week.

The ordering site your diners use and the kitchen tablet are in English. Our onboarding, support and printed staff sheet are in Spanish.

Prices and billing

All prices are in US dollars and are billed by Antojo.ai. The $2,999 is a one-time charge for the setup. The $99 is charged per location, per month, and starts on Launch Day. Applicable taxes may be added where the law requires it.

Launch Day is the single date on which your ordering site goes live and the installation is finished. We write it down together and both sides confirm it. The monthly service, the 90-day guarantee period and your ownership of the equipment all start on that date.

Term and cancellation

The monthly service is month to month. There is no long-term contract. You can cancel at any time by emailing support@antojo.ai or by messaging us on WhatsApp.

When you cancel, the service continues through the end of the month you have already paid for and then stops. Months are not prorated and monthly fees already paid are not refunded.

The $2,999 setup fee is non-refundable, except under the guarantee described below and in our refund policy.

Your equipment is yours

The kitchen tablet, the thermal printer and the router become your property on Launch Day. We never reclaim them: not if you cancel, not if the guarantee is paid out, and not for any other reason.

The guarantee, in summary

If your restaurant does not receive 100 online orders through its own ordering site in the first 90 days after Launch Day, we refund the $2,999 in full and you keep the equipment. An order counts if it was placed and not refunded. The full mechanics, including the conditions that void the guarantee, are in our refund policy, which is part of these terms.

When you leave

Everything is yours: your domain, your menu with its photos and descriptions, your customer list and your equipment. Your domain is registered in your name. If you leave, we hand over the menu and the customer list and we remove ourselves from your Google Business Profile whenever you ask.

What is not included

• Integration with third-party delivery apps such as DoorDash or Uber Eats, including menu sync.
• Point-of-sale integration or sending orders into a POS.
• In-person or card-present payments.
• Marketing services.
• Internet service or networking beyond the supplied router.
• Stripe's payment processing fees on your orders. Stripe charges them to your own Stripe account; see "Fees on online orders" below for how the online ordering fee covers them.
• Website content beyond the ordering site, such as a blog, reservations or catering forms.

Fees on online orders

Antojo.ai operates as a Stripe Connect platform. Diners pay with a card on your ordering site, and each payment goes directly to your restaurant's own Stripe account.

Online ordering fee. Diners pay an online ordering fee of 5.5% of the food subtotal plus $0.30 per order. It is shown to the diner as a separate line item at checkout, on top of the menu prices. This fee is part of this offer and stays active for the life of the service; it is what allows you to keep 100% of your food sales.

Platform fee. Antojo.ai receives a platform fee of 2% of the food subtotal of each online order. It is collected by Stripe from the payment and is never shown to the diner.

How this adds up. On each order, the diner pays the menu prices plus the online ordering fee. From that payment, Stripe deducts its processing fee and the 2% platform fee, and the rest lands in your Stripe account. Because the online ordering fee is larger than those two deductions combined, you receive the full food subtotal on every order, and usually slightly more. That is what "keep 100% of your food sales" means, and it holds only while the online ordering fee is active.

Diners and refunds for food orders

Each restaurant is the seller of record for food ordered through its own site. Diners' payments go directly to that restaurant's own Stripe account, and any refund for an order is issued by the restaurant. Antojo.ai provides the ordering software and does not sell food.

Your responsibilities

You are responsible for the accuracy of your menu and prices, for preparing the orders your kitchen receives, for the taxes your restaurant owes, and for keeping the equipment powered and connected. Please tell us about menu changes and we will make them; we do not change your menu without your request.

Our liability

We work hard to keep your ordering site running, but no online service is available 100% of the time. As far as the law allows, our total liability to you for anything arising from these terms is limited to the amounts you paid us in the twelve months before the claim, and we are not liable for lost profits or indirect losses. Nothing in these terms takes away rights the law gives you that cannot be waived.

Governing law

These terms are governed by the laws of the State of Utah.

Changes to these terms

We may update these terms. The date at the top shows when they last changed. If a change affects your price or your cancellation rights, we will tell you by email or WhatsApp before it takes effect.
